Merchandise terms and conditions

These Terms and Conditions apply to merchandise purchased directly from Loughborough Sport.

These terms are in addition to your statutory rights.

In these Terms and Conditions:

Merchandise means any clothing, equipment, accessories, gifts, souvenirs, or other products sold by Loughborough Sport.

Customer means the individual purchasing Merchandise from Loughborough Sport.

Loughborough Sport includes Loughborough University, Loughborough Sport, and its authorised employees and representatives.

2.1 By purchasing Merchandise from Loughborough Sport, Customers agree to these Terms and Conditions.

2.2 Loughborough Sport reserves the right to amend these Terms and Conditions where reasonably necessary. Any revised version will be published on the Loughborough Sport website and will apply from the date of publication.

2.3 These Terms and Conditions apply in addition to any rights available under applicable consumer protection legislation.

3.1 Loughborough Sport takes reasonable care to ensure that product descriptions, images, pricing, and availability are accurate.

3.2 Product images are provided for illustrative purposes only. Colours, sizing, and appearance may vary slightly from those shown.

3.3 Customers are responsible for reviewing product descriptions, sizing information, and suitability before making a purchase.

3.4 Some items sold by Loughborough Sport are fashion or leisurewear products and may not be suitable for sporting or performance use. Customers should ensure that products are appropriate for their intended purpose before purchase.

4.1 Merchandise purchased in person may be returned to a Loughborough Sport reception within 30 days of purchase, provided that:

  • Proof of purchase is supplied.
  • The item is unused.
  • The item remains in its original condition.
  • Any original packaging, tags, or labels are intact.

4.2 Returns without proof of purchase may be accepted at the discretion of Loughborough Sport. Where accepted, an exchange or credit may be offered based on the item's current selling price.

4.3 Refunds will be issued using the original payment method where reasonably possible.

4.4 Merchandise purchased at events, pop-up retail locations, temporary sales stands, or similar locations may only be returned where the item is faulty, damaged, or not as described.

4.5 Merchandise purchased at an event may not be eligible for a refund simply because the Customer changes their mind.

5.1 Customers should inspect Merchandise upon receipt and notify Loughborough Sport promptly of any fault, defect, damage, or error.

5.2 Loughborough Sport may offer a repair, replacement, exchange, or refund where goods are found to be faulty, damaged, or not as described.

5.3 Returns or remedies may be declined where a fault arises as a result of:

  • Fair wear and tear.
  • Accidental damage.
  • Negligence.
  • Misuse.
  • Failure to follow care instructions.
  • Unauthorised alterations or repairs.

5.4 Customers who believe an item is faulty should discontinue use and return the item for inspection.

5.5 Nothing in these Terms and Conditions affects a Customer's statutory rights in relation to faulty goods.

6.1 For hygiene reasons, the following items cannot normally be returned unless they are faulty:

  • Swimwear where the hygiene seal has been removed.
  • Personal care products.
  • Any item where hygiene packaging or protective seals have been broken or removed.

6.2 Returned items must be clean and in a condition suitable for inspection.

7.1 Merchandise that has been personalised, customised, embroidered, printed, or otherwise altered to a Customer's specification cannot normally be returned or exchanged unless faulty.

7.2 Customers are responsible for ensuring that all names, numbers, sizing, and customisation instructions are correct at the time of ordering.

7.3 Personalised, customised, printed, embroidered, or otherwise made-to-order products are non-refundable and non-exchangeable unless the item is faulty, damaged, or not as described.

7.4 This includes, but is not limited to:

  • Player names and numbers
  • Bespoke embroidery
  • Custom text
  • Team-specific personalisation
  • Products manufactured or altered to a Customer's specification

8.1 Merchandise purchased through third-party suppliers or external retail partners is subject to that supplier's terms and conditions.

8.3 Merchandise purchased through external suppliers cannot normally be returned, exchanged, or refunded through Loughborough Sport facilities unless expressly stated otherwise.

8.4 Customers should contact the relevant supplier directly regarding online order queries, returns, exchanges, or refunds.

9.1 All Merchandise is subject to availability.

9.2 Loughborough Sport reserves the right to amend prices, specifications, and product availability at any time prior to purchase.

9.3 In the event of an obvious pricing error, Loughborough Sport reserves the right to cancel or refuse an order prior to dispatch and provide a refund.

10.1 Merchandise sold as part of a sale, clearance, end-of-line, or promotional markdown may only be returned where the item is faulty, damaged, or not as described.

10.2 No refund or exchange will normally be provided for sale or clearance items where the Customer has simply changed their mind.

10.3 Statutory rights relating to faulty, damaged, or misdescribed goods remain unaffected.

11.1 Promotional offers are available only during the period specified.

11.2 Unless otherwise stated, promotions cannot be used in conjunction with any other offer, discount, or promotion.

11.3 Loughborough Sport reserves the right to withdraw, amend, suspend, or terminate promotions where reasonably necessary.

11.4 Any membership discounts offered on Merchandise may be limited to specific periods, products, or promotional campaigns and are not guaranteed throughout the full duration of a membership.

11.5 The Loughborough Lightning Season Ticket Discount is not valid on sale, clearance, reduced-price items, or other excluded products unless expressly stated.

12.1 Nothing within these Terms and Conditions excludes or limits liability for:

  • Death or personal injury caused by negligence.
  • Fraud or fraudulent misrepresentation.
  • Any liability that cannot legally be excluded or limited.

12.2 Subject to clause 12.1, Loughborough Sport shall not be liable for indirect or consequential loss arising from the purchase or use of Merchandise.

13.1 These Terms and Conditions shall be governed by and interpreted in accordance with the laws of England and Wales.

12.2 Any disputes arising under these Terms and Conditions shall be subject to the jurisdiction of the courts of England and Wales.
